Probate Forms
These forms can be filled out on our website, then downloaded and emailed to us at probateforms@marshallcountywv.gov. You must have an official Certificate of Death and the form must be complete PRIOR to scheduling an appointment with our office.
For Probate with Will, there is a fee for filing the Will and the appointment. The fee is typically under $70, but depends on the number of pages in the Will and the number of beneficiaries to notify. You must have the original Will.
For Probate without Will, an appointment fee is usually under $50 plus the cost of postage to notify each heir not present at the time of the appointment will apply.
Affidavit for Small Estate
If decedent's property meets the financial qualifications, please complete the form and return to this office for processing or you can make an appointment to file the same. The decedent must have been a resident of Marshall County at the time of death.
This form must be downloaded, filled out and notarized before scheduling an appointment with our office.
There is a cost of $12 for up to 5 pages and $1 per page thereafter.

Please complete the proper form with the attachments and return to the Marshall County Clerk's Office for processing.
